Refunds and Returns Guide

1.              APPLICATION

1.1.             This guide applies to all Goods purchased directly from Caravan and Camping Aus Pty Ltd ACN 660 478 428 (Company).

1.3.             Capitalised terms in this Guide are defined in the Company’s terms and conditions, available on the Company website.

2.              AUSTRALIAN CONSUMER LAW

2.1.             If the Customer is a Consumer under the Australian Consumer Law, the following applies:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure

2.2.             The Customer may also have other or additional legal rights under the laws of its jurisdiction. The disclaimers, exclusions, and limitations of liability under this Limited Warranty will not apply to the extent prohibited by applicable law.

2.3.             The Customer must provide the Company with proof of purchase (e.g. a receipt, online tax invoice, credit card or bank statements).  Any refund will be provided via the same method of payment as the original purchase.

2.4.             To assist us in resolving any problems you may experience, please inspect the goods upon taking delivery and report any shortage, discrepancy, defect, wrong specification or similar problem to us as soon as you become aware of it.

3.              PRODUCT WARRANTIES

3.1.             In addition to the rights and remedies you have under law, the Company or the third party manufacturer of the Goods may provide an additional warranty about the quality of a Good, or about what happens if the Goods are defective. 

3.2.             If an additional warranty is provided, the warranty period, provisions and the company providing the warranty will be clearly specified on or inside the product packaging.  The Customer should refer to these warranty documents to determine the terms and conditions of any such additional warranty.

3.3.             Information about how to make a claim under an additional warranty is set out in section 4 below.

3.4.             Any additional warranty does not include customer training and education, installation, set up or adjustment, signal or reception problems.

3.5.             Any additional warranty does not cover damage or defects to Goods due to, or caused by:

3.5.1.             forces beyond the Company’s reasonable control, such as internet or power outages, power surges, fires, earthquakes, floods or other events of “force majeure,” accident, misuse, abuse, negligence, commercial use or modification of, or to any part of the Goods;

3.5.2.             any third-party product, service or system, use of the Goods for purposes other than for which the Goods were designed or intended, use in improper temperature, humidity or other unsuitable environmental conditions, or use of the Goods in violation of written instructions provided by the Company;

3.5.3.             normal wear and tear or aging;

3.5.4.             improper repair, operation or maintenance or connections to electricity supply other than as recommended, or attempted repair by anyone other than the Company;

3.5.5.             use of the Goods for purposes other than for which the Goods were designed or intended;

3.5.6.             misuse of the Goods contrary to written instructions provided by us or the manufacturer (which may be provided at the time of purchase or on the Website);

3.5.7.             network or WIFI signal or reception problems, internet connectivity issues between the Goods, a router or smartphone.

4.              HOW TO MAKE A CLAIM UNDER A WARRANTY

4.1.             To obtain warranty service or to return a Goods, the Customer must send the Company an email on the details above with the Customer’s contact details and a description of the issue and photos (if relevant). 

4.2.             Many manufacturers have dedicated support centres designed specifically to deal with issues in relation to their products and the Customer may be able to obtain a quicker assessment and remedy directly with the manufacturer (although the Customer is not obliged to do so)

4.3.             If the Company agrees that the Customer may return Goods, the Goods must be shipped to the Company freight prepaid at the Customer’s expense; together with proof of purchase and all accessories, either its original packaging or packaging affording an equal degree of protection.

4.4.             In all cases, the Company’s determination as to whether or not Goods are defective and covered by a warranty will be final.

4.5.             If a Good is returned and the Company determines that it is covered by a manufacturer’s warranty the Company will either:

4.5.1.             repair the Good;

4.5.2.             replace the Good or any defective components or parts with a new or refurbished Good, component or part; or

4.5.3.             refund the original purchase price in return for the Good.

4.6.             Such repairs or replacement will be made at no charge to the Customer for parts or labour.

4.7.             Unless the Customer makes alternative arrangements with the Company, the Customer must pay charges related to shipping and handling of Goods that the Company returns to the Customer after determining they are not defective or otherwise fall outside of warranty coverage.

4.8.             The Company will pay all charges related to shipping and handling for replacement Goods.

4.9.             All returned Goods for which the Customer has received a replacement or refund will become the property of the Company.
